| 论广义二重起诉及其规制 |

| 摘 要： | 广义二重起诉是指前后两诉在争点及攻击防御方法上共通的现象,它虽然在本质上不属于重复诉讼,但却产生与狭义二重起诉类似的后果。广义二重起诉与判决效力中的争点效力对应,大陆法系国家主要采取强制合并与程序中止等方法对其进行规制。本文通过对我国现行法律规定的反思,提出了探讨解决这一问题的办法。

| Abstract: | Generalized reiterated lawsuit means that there are two suits which have common issues and defending methods,though it is not a kind of reiterated lawsuit constitutionally,it has the same effect with narrow reiterated lawsuit.Generalized reiterated lawsuit corresponds with issue preclusion validity of res adjudica,some countermeasures are adopted to deal with this problem,such as,constrainedly joinder of causes of action and suspension of court proceedings.Based on rethinking the existing law of our country,the author tries to find methods to solve this problem. |
