Considering the primary purpose of patent system,the international trend of intellectual property,and the need of the situation of our country,we should pay some attention to patent restriction while we study patent protection.Defenses to patent infringement during patent infringement dispute embody the balance between patent protection and patent restriction.This article discusses invalidity,an important,effective and usually used defense in defenses of patent infringement and corresponding issues and put forward related suggestions.
