我国网络著作侵权的立法现状及立法构想

网络著作侵权在网络侵权中发生的最频繁,问题最多。而在中国的著作权法方面,至今还未发现一部法律或法规能够充分阐明网络著作权保护问题。因此现在的当务之急是:法律的有权解释机关应当尽快对网络著作侵权方式做出立法或司法解释,完善著作权法,以便准确、及时地解决网络侵权纠纷。

The Legislative Situation and Conception on the Writing Infringement in Chinese Network

The writing infringement of network is happening with increasing frequency, and it's also dealing with different kinds of issues in the infringement of network. However, in Chinese law of writing right, there is still no law and regulation which can state fully how to protect the writing right of network. Thus, the argent matter at present is that the departments of laws must explain the way of the writing infringement of network with legislation and judicial as soon as possible and make the law of writing right better so that the issues on the infringment of network can be solved correctly and timely.
