| 摘 要： | 典当行经营范围的大小取决于国家对于该行业的定位,在继续保持其为中小企业融资定位的基础上,应当通过对《典当管理办法》第25条的阐释,对典当行的经营范围从广度和深度两方面进行拓展。典当行从事深度拓展后的营业行为,尽管超越目前关于典当行经营范围的规定,但应当认为仅违反了行政法上的管理性强制规定,并不导致担保物权合同无效。

| Abstract: | The business scope of pawnbrokers is based on the orientation to it of our country.If the function of pawnbrokers is still stabilized for financing of middle and small-sized firms,the business scope of pawnbrokers should be extended by interpreting the 25th clause of Management Measure of Pawn from extent and depth.While the business of pawnbrokers which is extended from depth exceeds the business scope being regulated in Management Measure of Pawn,but it should be still believed that the business only goes against the administrative mandatory provision of administrative law,so the effectiveness of security contract should not be denied. |
