诉讼艺术研究述评

诉讼艺术(含司法艺术)是指在各种诉讼实践活动中,当事人和司法机关创造性地运用法律解决社会纷争的方式和方法。它是人类法律智慧的结晶和表现形态,甚至代表着法律艺术的最高成就,因而人们自古以来就很重视对诉讼艺术的研究和运用。在简述诉讼艺术理论的基础上,文章扼要评述了国内外当代诉讼艺术研究基本情况,并审视了对中国传统诉讼艺术的研究实绩与缺陷。

Commentary on Litigation Art Research

Litigation art is a kind of technique and art which case litigants and judicial organs used to solve the social dispute creatively in lawsuit.It is the crystallization and form of legal wisdom of human being,signing the highest achievement of legal art.So people have given much emphasis on the research and using about it from the ancient time.On the basis of proposing author's own litigation art theory,this article gives a brief commentary on litigation art research of our time from home and abroad,and surveys research achievement and limitation to traditional litigation art of China.
