An Analysis of the Components of Computer Software End User License Agreements

A computer software end user license agreement (EULA) is a legal document between the software licensor and the end user with regard to the use of specific software. International license agreements have certain general patterns. Through analysis of a stratified sample, the research reveals that English EULAs differ a lot in length, and that 16 content components are frequently seen, which include: introduction, definition of terms, general use, server use, back-up copy, transfer of rights, intellectual property ownership, restrictions, compliance verification, internet and privacy, warranty and liability, export restrictions, governing law, solution of dispute, special terms, and general rules. The frequency of each component is analyzed, and the contents of 12 of the core components are summarized and evaluated, so as to provide reference for license designers and end users.
