宪法人权视野中的刑法解释观

人权价值是宪法的目的价值、核心价值,这决定了刑法目的是保护包括犯罪人在内的全体公民的基本人权。目前,我国刑事司法领域存在片面理解人权、忽视人权甚至侵犯人权等问题,破解问题之通途在于,建立保护与保障统一,情、理、法融合及以罪过原则为本的人权刑法解释观。目的解释作为这种解释观的根本方法,寓于法理与情理、规范与事实的类推过程之中。
