新刑事诉讼简易程序之立法得失探究

刑事诉讼简易程序在2012年3月全国人大对《中华人民共和国刑事诉讼法》的修法中被大幅增改。新简易程序保持了在刑事诉讼法中的原有地位,其案件适用标准、审判组织的选择、被告人对适用简易程序的影响、人民检察院派员出席公诉案件庭审、诉讼活动简易范围以及量刑与审限的关联均呈现出新特点,总体上朝科学化方向迈出了更大步伐。新简易程序立法之不足主要表现为编排结构不严密、个别条文内容分布欠当以及部分条文指引不明等等,这些问题都可探索出应对方案,但须通过全国人大修改法律或者最高人民法院作出司法解释才能得到合法解决。

On Probe into Legislation Gain and Loss of New Criminal Summary Procedure

Criminal summary procedure is substantially changed in revising Criminal Procedure Law of the People＇s Republic of China by NPC in March 2012.New simple procedure maintains its customary position in code of crimi-nal procedure.It presents new features in many ways such as its case applicable standards,option of the trial or-ganization,defendant＇s influence on applying to simple procedure,People＇s Procuratorate appointing staff attending court in case of public prosecution,simple range of litigation activity and relevance of measurement of penalty and institution of Time Limitation,and walks out greater pace towards scientific direction as a whole.The shortage of legislation of New simple procedure displays mainly on imprecision of the structure,distribution of content of indi-vidual provisions being indecent and parts of provisions guiding unknown,and so on.These issues could be tracked out replying schemes,which be legally solved by means of revising the law by NPC or making judicial interpretation by the Supreme People＇s Court.
