| 摘 要： | 主体不同、原因不同、对应罪状不同，是战争赔偿与民间损害赔偿的主要区别。两者不容混为一谈。日本政府拒不谢罪与赔偿，不但违反了国际法也违反了《中日联合声明》，构成了新的国际不法行为。日本右翼势力日益猖獗，迫使受害者不得不拖着伤残老病之躯，东渡日本力挽狂澜再次“抗战”，他们的成败是中日两国能否世代友好下去的试金石。

| Abstract: | Governmental claims for warfare damages differ from nongovernmental claims for warfare damag- es. Nowadays, the Japanese government refuses to offer an apology to the Chinese people and pay for the damages the Chinese people suffered in the war. Besides, the Japanese right wingers are attempting to resuscitate militarism. An this violates the international law and the Sino-Japan Joint Statement and makes the Chinese people filled with righteous indignation. Many Chinese people go to Japan to claim damages and their success or failure will serve as the touchstone for the friendship between China and Japan. |
