法治与德治的双轨建构

法与道德是人类社会最重要的两类行为规范 ,二者的关系历千年来一直就是一个探讨不衰、争论不休的法理学问题。从中国古代的儒法之争 ,到西方三大法学派的观点演变 ,二者合久必分 ,分久必合 ,随着时代的发展而不断变化着。作为同属社会调控系统子要素的法律与道德从不同方面、以不同方式、通过不同机制对社会生活的不同领域发挥着不同的影响和作用。作为治国方略 ,既要坚持以依法治国为主导 ,加快推进社会主义法治建设 ,又要坚持以以德治国为基奠 ,深入强化社会主义道德建设。将依法治国与以德治国紧密结合起来 ,通过合理的双轨建构使其功能达到最优化 ,是建设社会主义现代化的需要 ,也是党和国家在新世纪提出的基本治国方略 ,道德法律化和法律道德化即为其实现的必要途径。

The Double-Track Structure between the Rule of Law and the Rule of Virtue

Law and morality are two most important behavior standards in society and their relationship is an endlessly probed and ceaselessly argued issue in jurisprudence over hundreds of years. From the contention between Confucianism and Legalism in ancient China to the evolution of ideas in three law schools in the West, the law and morality changed with the development of society, frequently separating and integrating in turn after long intervals. As elements of regulation system in society, law and morality have different influence and function in different social fields by different ways and mechanisms. It is a general plan for national administration that we not only stress the rule of law as a main force to further the socialist legal system but also stress the rule of virtue as a foundation force to strengthen socialist moral system. We should closely combine the rule of law and the rule of virtue and better their functions by rational double track structure, which is the requirement for socialist modernization country advanced by our Party and Government in the new century.The legitimization of morality and moralization of law are the essential ways.
