论老年人犯罪不适用死刑

《刑法修正案（八）》首次规定了老年人犯罪不适用死刑，这是中华民族恤老文化的体现，符合刑法的人道主义价值和刑罚的目的，同时也实现了与国际人权的接轨。但现行规定也需要进一步完善，从而实现真正意义上的老年人犯罪不适用死刑。

No Death Penalty to the Old Criminal Offenders

The Eighth Amendment of the Criminal Law stipulates that no death penalty should be applied to the old criminal offenders. This is the embodiment of the traditional Chinese culture where the old are respected, and it also accords with the humanitarian values in the criminal law. Moreover, it complies with the aim of penalty and international legal practice. However, the Criminal Law also needs to be further improved, so that death penalty should not be applied to the old criminal offenders in the real sense.
