| 摘 要： | 知识产权保护一直是影响我国中小企业发展壮大的重要因素，通过建立自主创新者与剽窃者之间的博弈模型，可以推导出影响中小企业申报知识产权保护和知识产权侵权行为的外部因素，包括知识产权的申报和自行维权成本、对侵权行为的罚款额以及侵权者的剽窃成本。从知识产权立法的角度，可以分析出如何通过改善这些外部影响因素，为中小企业的知识产权工作创造有利的外部环境。

| Abstract: | The protection of intellectual property rights has been the important factors that impact SMEs＇ （small and medium enterprises） development. Through establishing the game model, we derived the external factors that impact SMEs＇ behavior in protecting and violating the intellectual property rights, including the cost of intellectual property rights＇ declaration and maintenance, the fine level for violation behavior, as well as the cost of piracy. From the perspective of intellectual property rights legislation, this paper analyses how to improve these external factors, and create a favorable external environment for SMEs. |
