| 摘 要： | 通过实证分析,醉驾入刑不能有效遏制醉驾,且存在查获不均、处罚不均、罪责刑不相适应、法律的公平价值受损等诸多弊端,并有造成司法资源浪费、滋生新的司法腐败、不利于和谐社会构建的现实风险。因此,对醉驾入刑的合理性有必要进行重新评估。

| Abstract: | After an analysis,Drunk-driving into a Criminal can not obstruct drunk-driving,and what's more,punishments are not equal,which may lead to waste and corruption in judicial system easily,unfavorable to form a harmonious society,so it is necessary to re-evaluate the rational nature of Drunk-driving into a Criminal. |
