论当代中国特色社会主义法律体系完善之路

当代中国特色社会主义法律体系形成之后仍需不断完善。基于人的自然、社会与政治三性,产生了私法、公法与社会法三法。但是,科学的法律体系必须是逻辑自足的系统,除了立法体系外,一切法律规范的创制都应该纳入法律体系之中。评判法律体系的形成和完善与否的标准,不应仅仅从数量方面来考量,更要符合调控水准、逻辑关联、价值理念和外部适应等方面的质量要求。当代中国特色社会主义法律体系的完善之路在于:坚持系统的自洽性与动态性的一致;从神、物本位彻底转变到以人的全面自由发展的权利为本位;奉行重点倾斜性与均衡协调性的统一;实现法律规范与其他社会规范的融贯;达至全局性与区域性、全球化与地方化的协调。
