论跨境旅游纠纷的法律适用

跨境旅游纠纷受国际私法的调整，在解决该类纠纷适用法律的时候将涉及连接点的选择，以及责任竞合的问题。连接点的选择往往是利益衡量的结果，而发生责任竞合时，笔者更倾向于选择侵权之诉。在解决了连接点的选择和责任竞合的基础上，才能够正确地选择法律适用原则，本文认为，在跨境旅游纠纷中引入意思自治原则将更有利于纠纷的解决和充分维护双方当事人的合法权益。
