权利保护的经济理论与中国转型期的地权流转

权利保护的经济理论认为,在权利转让方式中蕴含着权利保护的经济逻辑,权利转让是联系个体利益和社会整体利益的纽带,因此,个体权利的保护应该在社会整体的最优目标中来考察。通过对中国转型期地权流转的考察发现,中国的土地产权是一种没有防护的权利,权利的内在缺陷是导致失地农民利益受损和土地财政膨胀的主要根源。
