| 摘 要： | 最高人民法院《关于民事诉讼证据的若干规定》第七十七条对民事证据上的最佳证据规则作了规定。该条借鉴外国的最佳证据规则的原理并结合我国的司法实践,根据证据的不同分类标准,对不同种类的证据形式通过比较,对其证明效力的大小作出了不同的规定,从而确立了我国民事证据上的最佳证据规则。为了在司法活动中更好地、正确地理解和运用该规则,有必要对最佳证据规则的有关问题进行探讨和研究。

A Brief Discussion about the "Best Evidence Rule" |

| Abstract: | In "Rules of Evidence in Civil Suits" promulgated by PRC Supreme Court,the "best evidence rule" is defined in Article 77.Referring to some foreign best evidence rules and the judiciary in China,Article 77 compares different types of evidence,regulates the efficiency degrees of different types of evidence and sets up the Chinese "best evidence rule".In order to understand and apply this rule correctly,it is necessary to have a deep study of this rule. |
