论域名侵权纠纷的预防措施与解决途径

伴随网络电子商务的发展,域名侵权纠纷案件呈上升趋势.域名侵权纠纷案件可归纳为五种类型:由于域名的恶意抢注而引起的侵权纠纷,使用同一商标的商标权人因域名注册而引发的侵权纠纷,域名注册人侵犯注册商标专用权的侵权纠纷,域名注册人侵犯企业名称专用权的侵权纠纷,商标权人侵犯域名注册人权利的侵权纠纷.借鉴国外立法经验,阐述了防止域名侵权纠纷案件发生的四项预防措施:在域名注册程序中建立驰名商标、知名商标检索制度,规定域名注册人提供真实联系信息的义务,采取单一域名制,将域名保护制度纳入《商标法》的体系之中.结合一个典型案例,论述了如何适用统一域名纠纷处理程序、司法程序和仲裁程序等法律救济途径,解决已经发生的域名侵权纠纷.

Countermeasures Against Disputes Due to Infringement of Domain Names and Their Settlement

Accompanying with the development of electronic commerce,the number of disputes due to infringement of domain names is increasing.Those disputes can be divided into five types according to their causes,i.e.,forestalling the others maliciously to register a domain name;some owners of trademark,who have the same trademark,register their domain names;a domain name registrant infringes the exclusive right of a registered trademark;a domain name registrant infringes the exclusive right of a company's name;a trademark owner infringes the right of domain name registrant.Four countermeasures are therefore proposed and expounded to those disputes due to infringement of domain name by virtue of foreign experience in legislation as reference,i.e.,building a searching system for well-known trademarks in domain name registration procedure;stipulating obligation that a domain name registrant should provide true information on how to connect him; adopting single domain name system;bringing the domain name protection system into the Law of Trademark.A typical case is discussed on how to settle those disputes,such as unifying routine,judicial and arbitral procedures and the approach to the settlement of those disputes that had happened before.
