民生至上:紧急状态下的宪法视角

法治国家在面临突发的紧急的危险状态下,遮蔽民生,限制和克减基本人权应当遵从一定的法律和准则。从紧急状态下的宪法视角来看,国民基本人权保障与受限,限制国民基本权利和相关人权保护的理据,应遵循紧急状态下公益性条款对基本权利的限制原则、紧急状态下基本权利的法律保留原则、紧急状态下基本权利受限的比例原则。

Supreme Position of People's Livelihood in State of Emergency from Perspective of Consititutional Law

The paper addresses the response to people's livelihood under the state of emergency or state of tension,and discusses the laws and regulations which a country of rule of law should comply with under the state of emergency when restricting and derogating human rights.The paper also aims to explore the clauses of public intersts on protecting and restricting human rights,the principle of legal reservation,and the principle of proportion,and defines the sources of basic theories of the state of emergency from the perspective of consititutional law.
