| 摘 要： | ADR是指非诉讼纠纷解决方法或审判外纠纷解决方法,由于各国历史传统与文化的不同,在各国的表现形式差异很大,在我国主要是调解。诚实信用原则以其不确定性和衡平性的特质正好契合了在法制化大背景下的ADR制度的要求。文章通过从分析我国ADR中存在的问题和我国现行立法的不足入手,指出我国ADR的完善亟待引入诚实信用原则,并提出了完善我国ADR的建议。

| Abstract: | ADR is refered to as the Alternative Dispute Resolution.As a result of various countries' traditions and cultural differences,its expression differs in various countries.In our country it is mainly showed in the form of mediation.Good Faith principle,with its special characteristic of indefiniteness and equilibrium,has indeed met the demand of ADR system,against the legal system background.From the analysis of the promblems that exist in the ADR of our country and our country's insufficiency of present legislation,this paper points out that in our country the consummation of ADR urgently awaits introducing the Good Faith principle,and then makes the suggestion of consummation of our country's ADR. |
