习惯法在乡村治理中的法治功能探讨

习惯法是一个具有确定含义的法律概念,少数民族权利是支撑习惯法的核心内容,国家现行立法对少数民族习惯法持支持态度。习惯法作为乡村治理的一种本土法治资源,是传统乡土社会构建和稳定社会秩序的纽带,也是乡村社会治理最常见的一种表现形式。在乡村治理中必须坚持习惯法的基本法则,凸显习惯法在乡村矛盾纠纷处理中的基本功能,彰显习惯法在乡村社会治理中的法治功能。必须依据《民法总则》订立和修改习惯法,制定适应新时代要求的新型村规民约,国家法的施行应当与习惯法相得益彰。

A DISCUSSION ON LEGAL FUNCTION OF CUSTOMARY LAW IN RURAL GOVERNANCE

Customary law is a legal concept with a definite meaning,andthe rights of ethnic minorities are the supporting core content of customary laws.The current state legislation indicates a supportive attitude towards the customary laws of ethnic minorities.As a kind of local legal resources for rural governance,customary law is the bond of the building of traditional rural society and the stability of social orders,and it is also the most common manifestation of ruralgovernance.In rural governance,we must adhere to the basic rules ofcustomary law,highlighting the basic functions ofcustomary law in handlingconflicts and disputes in rural areas,anddemonstrating the legal functions of customary law in ruralgovernance.It is necessary to formulate and modify customary laws in accordance with the General Rules of Civil Law,and to produce new type of village regulationsadapting to the needs of the new era,making the implementation of state law and customary lawcomplement each other.
