我国集体建设用地使用权流转探论

摘    要:作为我国农村集体土地重要组成部分的集体建设用地,其所有权具有不完整性,其使用权作为一种土地用益物权,应合法进入市场有偿流转。集体建设用地使用权流转的主要内容由法律明确规定。国家对集体建设用地须依法征收并实行市场性补偿。政府在集体建设用地使用权流转中的职责主要是对市场进行公共管理和社会服务,并运用宏观调控手段实现城乡建设用地市场的全面接轨。

Abstract:Collective land for construction,an important part of the rural collective land has an incomplete proprietorship.The right to use it as a usufruct of land shall legitimately be introduced into the paid market circulation.The content of circulation of the right to use collective land for construction is stipulated by law.The expropriation of such land shall be conducted in compliance with the law and in return for compensation at market price.The responsibility of the government in this circulation is mainly to offer public management and social services to the market,and make sure by means of macroeconomic adjustment that the market for rural land for construction runs in line with that of the urban one.
