| 摘 要： | 各国立法及理论对民间文学艺术作品的法律保护存在极大的争议,从分析这些争议入手,对民间文学艺术作品法律保护进行了分析,认为我国应对民间文学艺术作品提供积极的法律保护,并从民间文学艺术作品的界定、权利主体的界定和权利保护三个方面提出了构建我国民间文学艺术作品法律保护的初步设想。

| Abstract: | At present there are still many heated disputes among many countries in law protection to folk literature art works.This paper consumes that our country should provide active law protection to folk literature art works and also puts forward some preliminary consumptions in building such law protection from aspects of definitions of folk literature art works,of the main body of rights,and rights protection through analyzing the disputes behind it. |
