《民国民法典》与比较法学

从世界法律编纂的历史上来看,法律比较从一开始就与立法活动密切相关,而比较法学的形成与发展,使得这种关联日益加深。民法典的编纂史也不例外,考察民法典的编纂与比较法学的关系对于当前我国民法典的编纂来说很有意义。

CIVIL CODE OF REPULIC OF CHINA AND COMPARATIVE LAW

In the legal history of code compilation,comparison of laws had close relationship with legislative activities from the very beginning.With the development of legal study,comparison of laws has already evolved into a higher level,i.e.comparative law,which deepens such kind of relationship.The history of compiling civil law is of no exception,either in the enacting or in amending process.Therefore,the study about the relationship between the compilation of civil law and comparative law is of great significance,especially for the on-going compilation of Civil Law Code of the PRC.
