城市化进程中少数民族非物质文化遗产的法律保护研究

在城市化的冲击之下,我国少数民族非物质文化遗产正在消失、消亡,遭到毁弃、随意滥用和过度开发。法律作为保护少数民族非物质文化遗产的有效手段,在实践中却没有很好地发挥其应有的作用,这种情况在很大程度上根源于我国非物质文化遗产保护方面的立法、执法建设落后于社会发展对非物质文化遗产保护的需要,以致法律保护还不能应对非物质文化遗产保护的紧迫性。

On Lawful Protection of Intangible Cultural Heritage in Ethnic Minority Regions in the Process of Urbanization

Under the attack of urbanization,the intangible cultural heritage of ethnic minorities is disappearing,dying out,suffering from destruction,abuse and over-development.As an effective means of protecting the intangible cultural heritage,the law has not come into corresponding force.To a large extent,this attributes to the fact that the legislation and execution of law cannot concur with the need of protecting the intangible cultural heritage.Therefore,the lawful protection cannot match the urgent need of protecting the intangible cultural heritage.
