| 摘 要： | 共同受托人与复数受托人、受托人的代理人以及基金管理人和基金托管人等概念不同。从共同受托人制度的历史起源、制度功能、法理以及立法等角度看,共同受托人“是在同一信托中对信托财产权共同共有的数名受托人”。除了同一信托、数名受托人之外,数名受托人对信托财产权的共同共有也是共同受托人概念之必备要素,不可或缺。

| Abstract: | Having compared the co-trustees with some related concepts,such as plural number trustees,trustee's agent,funds manager and funds trustee,and having analyzed its historical origin,system function,theory of the trust law as well as legislation,the author redefines the connotation of co-trustees and points out that the co-trustees should have the trust property by the mode of joint tenancy in the identical trust.Apart from identical trust,joint tenancy of several trustees is the essential and indispensable factor. |
