| 摘 要： | 目前我国行政法理论和制度对行政相对人行为的效力极不重视，进而忽视了相对人行为对行政权的监督制约作用。相对人行为的效力基础是权利和法律。效力类型包括启动力、中止力、终止力、阻止力、影响力、产生力、强制力、支配力、形成力等。理论和立法必须在相对人行为效力与行政行为效力之间保持适度平衡。
