宪法教学中的迷与思

摘    要:在宪法教学中,如下问题亟需澄清:即课程体系与实在法体系虽不必完全一致,但宪法理论的讲解必须以宪法规范的解释为目的而展开;宪法教学不能偏离宪法的核心价值诉求,应围绕公民基本权利、国家权力以及公共利益这三个基本要素而展开;宪法在本质上是具有特定内容的规范性诉求,而不是力量对比关系;宪法研究方法与宪法教学方法虽有紧密联系,但仍不应忽视两者的区别。

Abstract:In Constitution teaching, some problems are necessary to be clarified as follows: Curriculum system needn't maintain consistent with the law system completely, but the teaching of Constitution theory must aim to explain the rules concerned as its target. The constitution teaching can't deviate from appealing for the core value of Constitution, it should focus on three basic elements: the Constitutional civil rights, the state power and public interest. The constitution is in essence the particular normative demands, not balance of power relations. The research method and teaching method has close contact, but they are not the same thing.
