| 摘 要： | 两大法系规定有不同的要约承诺制度,尤其是在要约是否可以撤销和承诺何时生效这两个问题上存在明显区别。经济分析表明,二者之间的差别并不悬殊。此外,两大法系在沉默是否可以看作是承诺这一问题上有着相近的规定,这也是经济效率的必然要求。

| Abstract: | Two Schools of provisions have different systems of offer promise,especially in the offer involwing between the commencement date of revocation and commitment to these two issues.Economic analysis shows that the difference between the two is not in great disparity.In addition,it can be seen as Two Schools in silence is a commitment on this issue have similar provisions,which is the inevitable requirement of economic efficiency. |
