宅基地使用权自由流转之探索

长期以来,我国法律一直对宅基地使用权的流转进行严格限制,以致形成典型的城乡建设用地双轨制。立足民法的角度,分析其流转的可能性和必要性,并在维持集体土地所有权和充分发挥宅基地使用权保障功能的情况下,设计了宅基地使用权自由流转的路径。

Exploration on Free Transfer of Usage Right of Homestead

For a long time, Chinese laws have been strictly restricting the transfer of usge right of homestead, which leads to the typical two-track system for construction land in cities and countryside. From a perspective of Civil law, this thesis analyses the possibility and necessity of the transfer, and then designs the route of free transfer, on the condition that collective land ownership is maintained and security function of usge right of homestead is given a full play.
