| 摘 要： | 预售商品房合同中因情势变更导致显失公平而发生的纠纷日渐增多,而法律规定相对滞后,纠纷的处理缺乏依据。本文从我国情势变更原则的立法现状入手,对预售商品房合同中适用情势变更原则的必要性和可行性及适用的条件进行了分析,并提出了完善这一原则的立法建议。

| Abstract: | Dissension in the contract of presell commercial residential building is increasing gradually,but correlative laws lag relatively,as a result there are not enough base.Begin with the legislation according with the change of our country's situation,this paper analysed the necessity,feasibility and the conditions of the principles for situation changes and made advices on how to perfect these principles. |
