国家本位型刑事政策模式的探讨——刑事政策模式研究之二

根据马克思·韦伯"理想类型"研究的理论,刑事政策可以划分为3种"理想类型"模式,即国家本位型、国家·社会双本位型、社会本位型。国家本位型刑事政策是国家至上理念在惩罚犯罪中的表现形式。国家本位型刑事政策又可分为专制型刑事政策和极权型刑事政策。在国家至上理念的支配下,刑事政策构成的形式要素与实质要素在不同的形态中呈现出不同的变项,表现出不同的结构形态。

On the Pattern of Criminal Policy Based on the National Interest

Criminal policy has three kinds of ideal patterns according to Web's "Ideal Pattern", which is "the pattern of criminal policy based on national interest","the pattern of criminal policy based on national and social interest"and "the pattern of criminal policy based on social interest". The pattern of criminal policy based on national interest is a kind of representation of the theory of the supremacy of state. The kind of criminal policy demonstrates in two forms: the autocratic criminal policy, the extreme power criminal policy. Under the theory of the supremacy of state, formal and essential factors of criminal policy take of different forms in different states, and represent different characters.
