| 摘 要： | 法治是制约公共权力最有效的手段，这是具有自我纠错能力的执政党对“文化大革命”所造成灾难的原因进行反思后得出的结论。公共权力法治化的动因包括历史发展的潮流、执政党的倡导和政府的推进以及市场经济条件下社会观念的变迁，但主要动力是党和政府的推动。单一的政府推进型法治带有天然的局限性，但政府推进型法治是改革开放初期中国历史的必然选择。

| Abstract: | The ruling party being self-correcting ability has come to a conclusion by reflection about the Cultural Revolution that the rule of law is the most effective means of restricting public power. The motive force of rule by law that restrains public power includes the trend of historical development, the promoting of the ruling party and government and the changing of social attitudes in market economy conditions.
