| 摘 要： | 文章论述了我国现行的自然人属人法制度的三个特点,即一是在自然人属人法的标准问题上采用了住所地法、定居国法、经常居住地法、本国法、行为地法等多元结构模式;二是在将最密切联系原则适用于属人法领域过程中既遵循传统又有所创新;三是在属人法的适用范围问题上不仅考虑到了冲突法上的公平,也顾及了实体法上的公平。然后,进一步分析了我国现行的自然人属人法制度存在的八个方面的缺陷,并就我国在自然人的能力、结婚与离婚、夫妻关系、父母子女关系、收养、扶养、继承等属人法事项之法律适用的完善问题提出了相应的立法建议。

| Abstract: | Three basic characteristics and eight defects of the Chinese system of personal law of physical persons are analyzed in this paper, and the proposals concerning such issues in the applicable law as the physical person's legal capacity, the relationship of marriage, the relationship of family, adoption, succession and so on, are offered. |
