| 摘 要： | 基于对无因管理民法学的理论分析，并结合国际私法学大家莫里斯对无因管理提出的利益产生（损失）标准，不妨对我国将来在此方面的立法大胆地提出这样一个观点：对于国际私法中无因管理的法律适用标准，原则上应适用利益产生地国（亦即事务管理地或行为发生地国）的法律。

| Abstract: | With comparative studying methods, this thesis sums up various kinds of present theories and practices on applying the negotiorum gestio in conflict of law all over the world. And the authors design a new legislative pattern of application of negotiorum gestio in conflict of law from the angle of the validity of civil law with negotiorum gestio. |
