| 摘 要： | 迁徙自由是个体基本经济权利的重要组成部分。企业迁徙自由是公民迁徙自由的自然延伸。企业迁徙自由作为个体基本经济权利,主要目的是对抗公权力的非法侵犯。企业迁徙权的宪法保障要求明确规定公民迁徙自由以及建立基本权利保护的违宪审查制度。同时,企业迁徙自由也受到必要的合理限制。我国目前的企业迁徙自由存在宪法保障的制度性缺失,有必要进行完善和补救。

| Abstract: | Migration right is an important part of individual basic economic right.Enterprise migration right is natural extension of citizens'.As an individual basic economic right,the goal of Enterprise migration right is a resistance to illegal infringement from power.Constitution protection of enterprise migration right demands citizen migration right being expressly provided and constitutional review on basic rights protection being founded.At the same time,enterprise migration right is ought to be necessarily and reasonably limited.our present enterprise migration right has some system defects in constitution protection,which needs improving and remedying. |
