契约自由与社会公正的冲突和平衡 --我国合同法中契约自由原则的勃勃生机

通过对"契约自由"的历史发展的介绍,以及对"契约自由"的内涵界定和对"契约自由"与"社会公正"关系的理论分析,立足我国基本国情,明确了"中国合同法的发展与西方市场发达国家相比有着强烈的反差",提出了"契约自由是我国合同法的核心与灵魂,社会公正不能否定或取代契约自由"观点,并在此基础上,结合我国立法和司法实践,对我国合同法的进一步完善,提供了几条合理化建议.

Conflicts and Balance of Contract Freedom and Social Justice

An evolution of "contract freedom" is briefly introduced, followed by its definition and an analysis of the relationship between "contract freedom" and "social justice". Then this paper points out that in terms of the present national situation there is a lot of sharp contrast between the development of China's contract law and that of the advanced market - oriented western economies' contract law, and that "contract freedom" is the core of China's contract law, which defies any refusal or replacement because of social justice. Finally this paper proposes some ways as to facilitate the improvement of contract law in China.
