和谐社会的公共政策论

在构建和谐社会的政策实践中,不仅要重视管制公正、分配公正,更要强调矫正公正。矫正公正有助于摆脱被动公正的消极状态,以主动公正积极地去消除人们蒙受的痛苦和不公正。矫正公正能够成立的首要条件是公共政策具有符合社会正义要求的持续性,为此必须持续地对支撑公共政策的权力结构保持敏感。在我国,权威政策民主论和参与政策民主论与公共政策的权力结构密切相关。这两种政策民主观的冲突展示了对民主构成威胁乃至否定民主的因素,单独强调任何一方都无助于和谐社会建设。健全权威政策民主观的关键在于正当性,健全参与政策民主观的关键在于开放性。统合这两种民主观应该在政策民主论中强化这两个范畴。

A Public Policy of the Harmonious Society

In the policy practice of constructing the harmony society,not only the regulative justice and distributive justice but also the corrective justice must be stressed.The corrective justice helps to get rid of the negative state of passive justice,and actively eliminate the people's misery and injustice by active justice.The principal condition under which the public policy can exist is the durative which accords with the requirement of the society justice.Thus,the sensitivity to holding the public policy power structure must be constantly kept.In China,the authority policy democracy theory and participatory policy democracy theory are closely connected to the power structure of public policy.The conflict between the two policy democracy ideas demonstrates the factors which threaten the democracy,or even deny democracy,if one of which is stressed can not facilitate the construction of the harmony society.The key point of improving authority democracy theory is justifiability,and the openness is vital to improving participatory democracy theory.The two categories must be strengthened in the policy democracy theory for the conformity of the two democracy theories.
