| 摘 要： | 由于各国有关货物所有权转移方面的规定不同,因此,在涉外货物所有权转移法律关系中需要进行法律选择。国际社会关于货物所有权转移的法律适用主要有适用当事人意思自治原则和适用物之所在地法两种立法模式。中国国际私法应依货物所有权转移的法律性质而对货物所有权转移的法律适用进行规定。

| Abstract: | Because of the difference of transfer of ownership among countries,we must choose an applicable law in transfer of ownership concerning foreign citizens.There are two legislative modes about the applicable law of transfer of ownership,that is lex voluntatis and lex situs.The international private law of China should provide the applicable law of transfer of ownership according to the legal nature of the transfer of ownership. |
