| 摘 要： | 我国著作权法过去不承认临摹品享有著作权,修改之后的著作权法对临摹是否属于复制的形式之一,态度很模糊。应该从临摹涵义入手,结合著作权的取得条件,通过批驳目前对临摹品著作权问题的几种观点,分析认为临摹仍是一种特殊的复制,不具有著作权法所要求创造性,不应享有著作权。并对临摹者的权利和临摹品的正当使用给出了建议。

| Abstract: | From the meaning of a copy and the requirements for a copyright,some ideas about painting copyright are criticized.It is proposed that a copy,as a special replica,can not enjoy copyright for its deficiency of creativity which is needed by the copyright law.On the other hand,some advice about the painter's rights and proper usage of the copies are also given. |
