京津冀清洁生产协同立法问题研究

摘    要:清洁生产是治理区域性环境问题的有效手段和京津冀协同发展的重要方面,有必要通过京津冀清洁生产协同立法为其提供良好的制度保障。由于京津冀三地经济发展水平、科研创新能力以及地方发展定位各不相同,关于清洁生产的法律文件在效力层级以及具体内容上存在一定差异,综合考虑三地清洁生产发展的制约条件和相关立法与政策基础,协同立法应坚持三大产业全覆盖、标准统一、程序统一等原则,对清洁生产主管部门协调机制、专项基金制度建立、科技创新体系构建、信息共享平台搭建等进行协同设计,力求为京津冀清洁生产协同发展以及促进三地环境治理能力共同进步、产业结构同步升级提供明确的法律依据和制度保障。

Abstract:Cleaner production is an effective measure in environmental governance and an important aspect of the collaborative development in Beijing,Tianjin,andHebei.It is necessary to provide a favorable system to guarantee the collaborative legislation of cleaner production in these three regions.Due to the differences in economic development,scientific innovation and orientation of local development,the legal documents of cleaner production also differ in their effectiveness and contents in these three regions.Considering the constraints and relevant legalization and policy foundations,we think that the collaborative legalization should follow a principle of unified standard and procedure to cover the three major industries,collaboratively designing coordination mechanism,special funds,system of scientific and technological innovation and information sharing platforms for the competent departments.By doing so,we can provide clear legal basis and system safeguard for the coordinated development of cleaner production,for the improvement of environmental governance,and for the synchronic upgrading of industrial structures in these three regions.
