| 摘 要： | 我国水权制度的特点是作为行政主体的政府代表国家行使对水资源的所有权,作为民事主体的自然人和法人行使对水资源的利用权。与水资源相关的主体具有行政主体和民事主体的双重属性,不但在民法理论上引发有关水权性质的讨论,也无法满足现实中对水资源保护和利用的要求。将水权的性质定位于水资源占用权,有利于解决理论上的困境,防止水资源的浪费,更好地实现水资源的价值。

| Abstract: | In our country,the ownership of water is exerted by the government,which is the representation of China,while the utilization of water belongs to natural person and juristic person.The subjects related to water resources bear the dual properties of being administrative and civil.It not only raises the discussion on the characteristics of water right but also cannot meet the needs of water protection and utilization in reality.Defining water characteristics as water possession can contribute to tackling theoretical predicament,preventing the waste of water,and better realizing the value of water. |
