| 摘 要： | 合同自由经历过辉煌但某种程度也带来了一定的动荡.作为政府示范合同,有其自身的特点和内容,严格区别于格式合同、自由合同、行政合同等,但它绝不是对合同自由的颠覆,而是对自由的保障,它既涉及个人利益,也涉及团体和社会利益,所以,政府示范合同的自由应受到一定限制.

| Abstract: | Contract freedom had its good days and experienced turbulence too. The government model con- tract distinguishes seriously from the form contract, free contract, and administrative contract. It has its own characteristics and the contents, but it is not to overthrow the contract freedom. It the guarantee of freedom since it involves the personal interests and the society benefits. Therefore the government model contract should be restricted to certain freedom. |
