我国农村集体土地所有权制度的立法构造

农村集体土地所有权制度是我国土地权属制度的基本形式之一。长期以来围绕农村集体土地所有权问题实践中纠纷迭起,理论上争论纷纭。土地所有权的主体不明,土地所有权的权能弱化是当前我国农村集体土地所有权制度面临困境的主要原因。因此,在对当前各种改革思路具体分析和评价的基础上,提出摆脱目前我国农村集体土地所有权制度困境的根本出路:立法上明确规定以村为单位的农民集体为农村集体土地所有权的主体;设立村集体财产管理委员会代表村民集体行使村集体土地所有权和通过构建集体土地使用权制度来完善农村集体土地所有权。

Analysis on the Dilemma of Legislation and Solution of the Rural Collective Land Ownership system of China

The rural collective land ownership system is one of the basic forms of our country land ownership system.For a long time,the rural collective land ownership system is often disputed in practice and gets diverse and confused in theory because of the ambiguity of the subject of the rural collective land ownership and the weakness of the rights of the rural collective land ownership.Based on the analysis and evaluation of the currently various schools of thought about the reform policy,the article puts forward the final solution to remove the dilemma of the rural collective ownership system,i.e.in order to make the village collective land system perfect,a village is taken as a basic unit of the subject of rural collective land ownership to establish a Village Collective Property Committee exercising on behalf of the villagers the rights of the village collective land ownership and to set up a system to use the collective land.
