| 摘 要： | 通过分析、比较UNCITRAL《运输法草案》与美国 1916年《提单法》、英国 1992年《海上货物运输法》关于诉权条款的特色 ,探讨了修订我国《海商法》的建议 ,明确享有诉权的主体、行使的条件和范围 ,设定提单转让之后的诉权及未遭受损失的举证责任。

| Abstract: | There is a comparison of character concerning rights of suit enjoyed by holder among Transport Law (draft),Pomerene Bills of Lading Act 1916 and Carriage of Goods by Sea Act 1992 in the world. In addition it is intended to be a remedy for the legislation and revision of CML. As a result it may be established a lawful subject, foundation and limits especially for beneficiary endorsed by holder of B/L and proofs burden. |
