论我国野生植物资源法律保护存在的不足与对策

野生植物资源对人类生存和发展具有重大意义。由于我国对野生植物保护力度不够，野生植物生存正面临极大威胁。目前，我国对野生植物的保护和管理主要是依据《野生植物保护条例》。该条例由于效力层级低，立法目的偏重保护野生植物的经济价值而非生态价值，对野生植物资源保护范围规定的过于狭窄，对违法行为的处罚范围和处罚力度较小，致使其在保护野生植物资源方面没有发挥应有的作用。与此同时，森林公安执法队伍力量弱小，其与海关、边防武警在打击走私执法中配合不协调以及执法人员在对外贸易方面执法专业性不强等原因严重阻碍了野生植物保护执法工作的顺利开展。此外，公民环境保护意识薄弱，也人为造成了野生植物资源的破坏。基于此，本文着重从立法、执法和提高公众保护意识三方面提出保护我国野生植物资源的法律对策。

Discussion on the Deficiencies of Legal Protection of Wild Plant Resources in China and the Countermeasures

The wild plant resources are of great significance to the survival and development of mankind. The survival of wild plants in China is faced with great threat owning to inadequate dynamics of protection for them. At present, the protection and management of wild plants in China are mainly on the basis of ＂Wild Plants Protection Regulation＂. But the regulation doesn＇t play its role in the protection of wild plant resources due to its low authenticity, the purpose of legislation stressing on protecting the economic value, not the economic value of wild plants, the limit in scope of the protection of wild plant resources and the limited scope and dynamics of penalty for illegal activities. Meanwhile, the law enforcement for the protection of wild plants is seriously impeded as a result of the small and weak power of ranks of law enforcement of forestry public security, and its uncoordinated cooperation with customs and frontier armed police and poor specialty of law enforcement in the fields of foreign trade. Moreover, the weak public awareness of environmental protection causes the destruction of wild plant resources by human beings. Therefore, the article puts forward the legal countermeasures of protection of wild plant resources from the perspectives of improving legislation, enforcement and enhancing the public awareness of protection.
