制定“政党法”的必要性和可能性分析

我国目前没有专门的政党法,只是在宪法的序言和总纲部分对我国的政党和政党制度作了原则性规定。在依法治国的条件下,有必要制定中国政党法,以依法规范政党活动,促进国家的政治文明建设。同时,我国制定政党法的主客观条件已基本具备,具有进行立法的可能性。

On the Necessity and Possibility of the Enactment of "Party Law"

At present there is not any special law of political party in China but some stipulations of principle for the political parties and political party system in our country in the preface and general principles of the constitution. On the condition of ruling by law, it is necessary to enact the Chinese law of political party to regulate the activities of the political parties and promote the construction of our political civilization by law. Moreover, as the subjective and objective conditions for enacting China's law of political party are already mature, it is possible to enact the law of political party in China now.
