法律社会学研究范式的转向：由现代性到后现代性

法律社会学的研究范式既要受到学术共同体思维进路的影响,更要受到社会变迁的制约。法律社会学孕育、成长于现代性的母体中,现代性是法律社会学研究范式的内在理据。现代性首先被认为是一种独特的线性的历史时间意识,长久以来的历史决定论是社会理论传统的主导维度。全球化时代,时空体验的巨大转变使人们将关注的焦点从时间移到空间。现代性向后现代性或全球性的转变,使得法律社会学的现代式的研究范式面临终结,新的研究范式(全球性的)需要建构,法律社会学的研究范式正从现代性向后现代性转向。

The Diversion of the Study Saradigm of Sociology of Law:from Modernity to Post-Modernity

Not only the thinking pattern of academic community but also the social change has deep effects on the study paradigm of sociology of Law.The modernity gave birth to and brought up sociology of law,it is the potential reason of the study paradigm of sociology of Law.The modernity first is taken as a particular linear history time consciousness,history determinism is the central dimensionality of social theory in a long time.The contemporary globalization and the great changes of the space-time experience make people pay close attention to space.The transformation from modernity to post-modernity or globality causes the study paradigm of sociology of Law to face end conclusion,then the new study paradigm needs to be constructed,the study paradigm of sociology of Law is to change direction from the modernity to the post-modernity.
