| 摘 要： | 《劳动合同法》的颁布使得竞业限制制度对商业秘密的保护有了明确的法律规定。运用比较分析的方法，介绍商业秘密保护中的法定竞业限制制度和约定竞业限制制度，比较两者对于商业秘密保护的不同，并立足于对商业秘密的完整保护，对法定竞业限制制度和约定竞业限制制度的完善提出建议，以更好地保护中国的商业秘密。
