| 摘 要： | 自从德国民法典区分物权与债权并抵押权归入物权后，学者们不断质疑争论。文章认为各家争议的实质在于反思传统法学概念。从法律价值角度看，抵押权虽不具有物权的典型特征，但把抵押权归入物权并无不妥。

| Abstract: | Since the German Civil Code distinguished real right from debt right and classified mortgage right into real right, scholars had many arguments about the nature of mortgage right. This article points out that the nature of these arguments is the reflecting of the Concept Legal Science. Then, I will analyze the mortgage right from the angles of the Concept Legal Science and the legal values. I will get my conclusion that mortgage right is not a typical real right and do no harm if We classify it into real right. |
